**POS Equipment Agreement**
These terms apply to the purchase of epscy POS hardware products. By placing an order for POS hardware, you acknowledge and agree to the terms of this agreement.
**Availability**
We make every effort to maintain sufficient inventory of all our offered products. However, potential stock shortages at our distributor may impact our ability to fulfill an order. We reserve the right to cancel an order if, for any reason, we cannot meet the order requirements. In such cases, we will notify you via email.
**Shipping**
Shipping delays may occur due to inventory shortages or other fulfillment issues. Your order is shipped using a service we have selected, and we cover the shipping cost within Bangladesh. Once your order is placed on our online store, we will provide you with an estimated shipping time. Please allow 1-2 business days for processing + delivery. While we strive to facilitate timely delivery, we cannot guarantee any specific delivery date once the order is in the hands of our chosen shipping carrier.
**Returns and Refunds**
We aim to ensure your complete satisfaction with your purchase. If a product is not suitable, you may return your hardware within 30 days of shipment, provided it is in new condition and in the original packaging.
Please note that Chip & Swipe Readers and physical gift cards are non-returnable and non-refundable.
Returns beyond 30 days will not be accepted. We only accept returns of hardware sold directly to you. We cover the cost of a hardware return if shipped back using the provided return label and the specified carrier. Priority shipping costs selected at checkout are non-refundable. We reserve the right to refuse returns if there is suspicion of abuse of the return policy.
**End-users and Resellers**
Our hardware systems are designed specifically for epscy merchants. We reserve the right to refuse selling and shipping any product if there is reason to believe you are not an epscy customer. Consumer aid is only available to the original hardware purchaser. Currently, we do not sell to or work with resellers.
**Warranties**
We sell a combination of our own and third-party hardware to create a modern point-of-sale.
*Please Note:*
The warranties on the devices are based on the original unit’s fulfillment date. A replacement unit does not extend the 1-year warranty included with POS Lite or as part of POS Pro.
These warranties cover defects in manufacturing found during the product’s recommended use. The warranty does not cover damage caused by misuse, abuse, unauthorized modification, improper storage conditions, lightning, or natural disasters. **Limitation of Liability**
epscy does not accept liability beyond the remedies set forth herein for the purchase, use, or return of POS hardware or other products. This includes, but is not limited to, any liability for the product not being available for use, lost profits, loss of business, or lost or corrupted data or software. epscy will not be responsible for any consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages or for any claim by any third party. You agree that for any liability related to the purchase of products, epscy is not liable or responsible for any amount of damages above the invoiced amount for the relevant product. Some jurisdictions may not enforce all of these limitations, and only the limits lawfully applied to you in your jurisdiction will apply.
